By purchasing through www.espresso-products.co.uk you agree to be bound by the Terms and Conditions laid out below.  These conditions do not affect your statutory rights as a Consumer.

Definitions:

"Buyer" means the Consumer who buys or agrees to buy Goods on this website from Universal Espresso Care
"Goods" means all products listed on the order and the order confirmation e-mail
"Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
"Special Items" means any Goods that are not held in stock by Universal Espresso Care and are ordered and/or manufactured and/or modified specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address specified on the order.

 Ordering from Universal Espresso care 

 Any order placed by the Buyer and accepted by Universal Espresso Care is subject to the following terms and conditions unless specified in writing by Universal Espresso Care.
A confirmation of your order will be sent by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted by Universal Espresso Care.
Universal Espresso Care retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
If a product is out of stock when you place your order, we will contact you to let you know when we expect to be able to ship it. If a product is completely unavailable when you place your order, we will contact you to arrange an alternative replacement or refund of any monies paid.
While every effort will be made to ensure that all items shown in our on-line product catalogue are in stock we offer no guarantee of availability and this electronic publication does not constitute an offer for sale.
We will usually dispatch goods within 48hours. If we are unable to dispatch your order within 4 working days, we will contact you by e-mail with an estimated dispatch date and offer you the option of cancelling the order. We reserve the right not to accept an order.
Please Note: Goods which are not held in stock by Universal Espresso Care and are ordered and/or manufactured and/or modified specifically for the Buyer cannot be cancelled once the order has been accepted by Universal Espresso Care.
 

Payment to Universal Espresso Care

Full payment is required at the time the order is placed and Universal Espresso Care will collect the payment from the debit/credit card details supplied unless otherwise agreed at time of order.
All Prices and charges on this site are in U.K. pounds and exclude any V.A.T payable at the prevailing rate.

Risk and Ownership:

The Goods shall be at the Buyer's risk once delivery has taken place. The Buyer must take all reasonable care of the Goods.
Should the Goods returned to
Universal Espresso Care​​​​​​​ having been damaged while in the Buyer's care, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.

Limitations of Liability:

Universal Espresso Care total liability in regard to the performance of this contract shall be limited to the value of the Goods.
Universal Espresso Care shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance or non performance of this contract.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.
All contracts shall be governed by English Law.
 

Faulty Goods:

Complaints relating to faulty Goods should be notified in writing within 7 days of the fault becoming apparent and should be addressed to:-  Customer Services Department,Universal Espresso Care, Unit 23 Bellevue Enterprise Centre, Ivy Road, Aldershot, Hants., GU12 4QW
In the rare event that Goods develop a fault, Universal Espresso Care retains the right to have the Goods repaired or replaced at Universal Espresso Care discretion, and any delivery costs associated with the exchange of faulty Goods will be met by Universal Espresso Care.
Where Goods are reported as faulty later than seven days after delivery, we require photographic evidence of the fault. Where upon we shall make a decision:
1 – To replace the item like for like.
2 – Make an allowance for the final acceptance of goods.
3 – Arrange for an independent inspection.
4 – Refuse the claim.
Or 5 – Refund the buyer upon receipt of the faulty item.
If the goods returned or at the time of the inspection are found not  to be faulty but the result of fair wear and tear, negligence or wilful damage, Universal Espresso Care retains the right to charge £75 for the inspection and to cover it’s costs. This charge will be taken from the debit/credit card used to purchase the Goods. The Buyer and Universal Espresso Care shall both agree to be bound by the results/findings of the inspector.
 

Refunds:

Refunds on Goods cancelled prior to dispatch will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 10 working  days of that written notice. All refunds will be made onto the same card used to make the original purchase.
Refunds for cancellations made after the order has been confirmed by email will incur a £30 administration charge.
Please note cancellations can only be accepted if the Goods have not gone into production as goods ordered from the manufacturers on the Consumers behalf are classed as bespoke items.
Refunds on Goods already delivered will take place as soon as possible following the return and inspection of such goods and in any case will not exceed a period of 14 working days following that return.

WARRANTIES AND DISCLAIMERS

All credit card details are entered and stored securely by Meta Charge (Paypoint.net) merchant services.
Where applicable prices are shown in Pounds Sterling and exclude VAT
The information, products and services contained on this web site may be out of date or include omissions, inaccuracies or other errors. All information is provided on an 'as is' basis.
All items offered are subject to availability and we reserve the right to refuse any order.
Prices and specifications may change without prior warning.
All sizes where quoted are approximate only. Colours may vary due to manufacturing runs.
Universal Espresso Care reserves the right to make changes to this web site at any time without notice.
Colours. The colour of goods may vary slightly from that shown on the website due to limitations of browser software, photo quality and monitors.
Indemnity. You agree to indemnify us against any claims, losses, liabilities, damages and expenses (including legal fees), arising out of your use of this site.
Consumer Rights. None of these Terms and Conditions affects your statutory consumer rights.
 
Once checked and signed for all products/items are the responsibility of the purchaser, the purchaser must be over 18 years of age to complete transactions. This does not affect your statutory rights as a consumer.
Delivery is normally within 4 working days (UK Mainland) and is the responsibility of the purchaser once the order has been received by them.
As a company we make every effort to maintain stock levels but, as we introduce new items, we phase out some of the old ones. Inevitably stock levels of these items will fall.
